3.2 What We Do NOT Provide
Get My Bond does NOT provide:
- Legal advice or legal representation
- Attorney-client relationships
- Guaranteed outcomes in bond disputes
- Representation at hearings
- Direct communication with landlords, agents, or hearing bodies on your behalf
- Legal services as defined under Australian law

4. Eligibility and Account Registration
4.1 Age Requirement
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old.

- All future updates and improvements to the Service
- Access to your generated documents and case information
5.3 Payment Processing
Payments are processed securely through Stripe, our third-party payment processor. We do not store your credit card information on our servers. By making a payment, you agree to Stripe's terms of service.
5.4 Taxes
All prices are in Australian Dollars and include GST where applicable. You are responsible for any additional taxes that may apply in your jurisdiction.
5.5 No Recurring Charges
This is a one-time payment. There are no subscription fees, recurring charges, or hidden costs.
6. Refund Policy
6.1 Refund Eligibility
We offer refunds within 14 days of your purchase if:
- You have not accessed the advanced features of the Service
- You have not generated or downloaded documents
- You have not used the AI evidence analysis feature
- You request the refund within the 14-day window
6.2 How to Request a Refund
To request a refund, contact us through your account dashboard within 14 days of purchase. Include your account email and reason for the refund request.
6.3 Refund Processing
Approved refunds will be processed within 5-10 business days to your original payment method.
6.4 Non-Refundable Circumstances
Refunds will not be provided if:

- You have accessed advanced features, generated documents, or used AI analysis
- You have violated these Terms
- You request a refund after achieving a successful outcome
7. User Responsibilities

10.3 Information Accuracy
While we strive to provide accurate and up-to-date information, we do not warrant that:
- The information is complete, accurate, or current
- The Service will meet your specific needs
- The Service will be uninterrupted or error-free
- Any errors will be corrected
10.4 "As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.5 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US ($29 AUD).
11.2 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

12. Indemnification
You agree to indemnify, defend, and hold harmless Get My Bond, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any information or content you provide through the Service
- Any hearing proceedings or bond disputes you engage in

Payment processing is handled by Stripe. We do not store your credit card information on our servers.

14. Third-Party Services

- You engage in fraudulent or illegal activity
- You abuse or misuse the Service
- We are required to do so by law
15.3 Effect of Termination
Upon termination:

- You will retain access to any documents you have downloaded
- We may delete your account data in accordance with our data retention policies
- Provisions of these Terms that by their nature should survive termination will survive

You agree to submit to the non-exclusive jurisdiction of the courts of the state or territory where you reside for the resolution of any disputes.

These Terms are subject to the Australian Consumer Law and other applicable consumer protection legislation. Nothing in these Terms excludes, restricts, or modifies any rights you may have under such legislation.

If you access the Service from outside Australia, you are responsible for compliance with local laws. The Service is intended for use by Australian residents dealing with Australian rental bond matters.
20. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather
- War, terrorism, or civil unrest
- Government actions or regulations
- Internet or telecommunications failures
- Cyber attacks or security breaches
- Pandemics or public health emergencies
During such events, our obligations will be suspended for the duration of the force majeure event.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
22. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Get My Bond regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Get My Bond.
